If changing the color of the Now Playing List icon to yellow isn't acceptable, then how about creating a different icon? Maybe replace the middle circular dot with a now-playing arrow, but then make the whole thing bright white so it doesn't look disabled.
Here's two screenshots, one with the AddToPlaylist (and also the Share and SetAs) menu options
enabled (on-device track) and one with them
disabled (UPnP track). On the disabled page, the Add to Playlist icon (in the menu) is indistinguishable from the Now Playing List icon in the toolbar.
Also, you can see how uneven the spacing below the album art is. I have my system font size turned up one tick from normal, and that's why the album name is truncated—but all of that text is ridiculously small given the space around it, in addition to being uncentered. In landscape mode, the text placement is OK, but still too small.
